These terms set out the rules for using atsminiradio.com, including the ATS Mini Controller app. They are the terms of service required by Art. 8 of the Polish Act of 18 July 2002 on providing services by electronic means. They can be read, saved and printed free of charge at any time.

1. Service provider and definitions

The Site is run by Grzegorz Zając, a sole trader trading as WebUncle Grzegorz Zając, ul. gen. Kazimierza Pułaskiego 27A/2, 40-276 Katowice, Poland, tax ID (NIP) 9542783954, registered in the Polish Central Registration and Information on Business (CEIDG). Email: contact@atsminiradio.com.

“Provider” means the entity named above, “User” means anyone using the Site, and “Site” means atsminiradio.com with all its pages and the app.

2. Services

All services are free and require no account. The Provider offers the following services by electronic means:

1. The ATS Mini Controller app: controlling an ATS Mini receiver from the browser over USB or Bluetooth, including tuning, memory channels, screenshots, the spectrum scanner, the logbook and audio decoding.
2. The firmware installer: writing software to the receiver over USB.
3. Information content: guides, resources, the Gear section, the changelog and the About page.
4. Supporting data from third parties: the EiBi station schedule, propagation and solar data, weather, and POTA, DX Cluster and PSK Reporter spots.
5. The “Recently heard” feed: publishing logbook entries that the User chooses to share.

The Site contains labelled AliExpress affiliate links. They appear next to products in the Gear section, which gear recommendations in the guides, on the resources page and next to the “Recently heard” feed also lead to. If the User buys something after clicking such a link, the Provider may earn a commission. This does not change the price the User pays.

The Site is not an official product of the ATS Mini manufacturer or of the authors of its firmware.

3. Technical requirements

• a device with internet access and an up-to-date browser with JavaScript enabled;
• to control a radio: a browser that supports Web Serial or Web Bluetooth, that is Chrome, Edge or Opera on a computer, or Chrome on Android (Bluetooth only); Safari and Firefox are not supported;
• an ATS Mini receiver with compatible firmware, and a USB cable or Bluetooth;
• for the firmware installer: a computer, a browser that supports Web Serial, and a USB connection;
• to remember settings: a browser that allows sites to store data.

4. Start and end of the agreement

The agreement for the services starts when the User begins using the Site and lasts for as long as they use it. The User can end it at any time, without giving a reason and at no cost, simply by no longer using the Site. The service of publishing an entry in the “Recently heard” feed is performed when the entry is published.

The Provider may stop providing a particular service or the whole Site, for example for technical or legal reasons. Where possible, a planned shutdown of the Site will be announced on the Site in advance.

5. Rules of use

When using the Site, the User must not:

• provide unlawful content;
• publish false, invented or bulk entries in the “Recently heard” feed;
• disrupt the Site, get around its security measures or limits, or overload it with automated requests;
• infringe the rights of others.

6. The “Recently heard” feed and content moderation

Publishing to the feed is voluntary. Sharing stays off until the User turns it on in the logbook or publishes a single entry.

Before an entry is saved it is checked automatically: data format, reception time (not later than the present moment and not older than 30 days), mode (AM, LSB, USB or FM) and minimum signal level. The station name is stored only if it matches the public EiBi list; otherwise the entry is published without a name. Cloudflare limits the number of requests from a single IP address. Entries are shown newest first, with no algorithmic selection or promotion.

The Provider may remove an entry that breaks the law or these terms, for example one that is false or spam. The decision is made by a person after reviewing the entry. All entries are deleted automatically after 30 days. Entries are not linked to any account or email address, so the Provider will usually have no way to tell the author that an entry was removed.

7. Reporting illegal content and point of contact

The point of contact for Users and for the authorities of EU Member States, the European Commission and the European Board for Digital Services (Arts. 11 and 12 of Regulation (EU) 2022/2065, the Digital Services Act) is contact@atsminiradio.com. Correspondence is handled in Polish and English.

Anyone who believes the Site contains illegal content can send a report to that address. It should include:

• an explanation of why the reporter considers the content illegal;
• the exact location of the content: the page address and, for the “Recently heard” feed, the time and frequency of the entry;
• the reporter's name and email address (not required if the report concerns child sexual abuse offences);
• a statement that the reporter is acting in good faith and that the information in the report is accurate and complete.

The Provider confirms receipt, handles the report promptly, carefully and objectively, and emails its decision to the reporter. The reporter can ask for the matter to be reconsidered by writing to the same address, and can pursue their rights in court.

8. Specific risks

As required by Art. 6 of the Act on providing services by electronic means, the Provider gives notice of the risks connected with using the Site:

• The firmware installer writes to the receiver's memory. A wrong file, a disconnected cable or a power loss during writing can leave the radio unable to start. Before writing, make the backup the installer offers and follow the guides on installing and backing up and recovering firmware.
• Serial port and Bluetooth access is granted by the browser only to the device the User picks. Devices the User does not recognise should not be picked.
• Supporting data (schedules, propagation, weather, spots) comes from third parties. It may be incomplete or out of date and is not suitable for anything on which someone's safety depends.
• External links lead to other companies' sites, which operate under their own rules.
• General internet risks, such as malware and impersonation of well-known sites (phishing). The Site never asks for passwords or card details, and support payments are accepted only through Buy Me a Coffee.

The Site stores data on the User's device that it needs to work: a language cookie, app settings and a cache. Their function and purpose are described in the privacy policy.

9. Liability

The Site is free. The Provider takes care that it works properly but does not guarantee uninterrupted availability, compatibility with every receiver version and firmware, or the accuracy of third-party data.

The Provider is not liable for damage resulting from use of the Site contrary to these terms or its instructions, for the operation of third-party sites and services, or for interruptions to the Site that the Provider could not prevent. These provisions do not exclude or limit the Provider's liability for damage caused intentionally, or liability towards consumers to the extent the law does not allow it to be excluded or limited.

10. Complaints

A complaint about the Site can be submitted by email to contact@atsminiradio.com. It should describe the problem. The Provider replies within 14 days of receiving the complaint, to the email address it was sent from.

A consumer can also use out-of-court dispute resolution, for example ask a consumer organisation or the competent consumer ombudsman for help, or, in a dispute with a trader from another EU country, the European Consumer Centre.

11. Voluntary support

A User who finds the Site useful can leave a voluntary tip through Buy Me a Coffee. A tip is a thank-you for the Site, which is provided free of charge, not the price of any service. It gives no access to extra features or other benefits, and the Site works the same for everyone.

The payment is handled by Buy Me a Coffee (Publisherr Inc) and Stripe under their own terms. The Provider does not store payment card details.

Refunds. Within 14 days of a payment, a refund can be requested without giving a reason. A payment made by mistake (for example the wrong amount or twice) or without the cardholder's consent is refunded after that period too. The full amount is refunded to the card or account used for the payment, within 14 days of the request. The support page explains how to ask for a refund.

These rules do not limit the payer's rights towards their bank or card issuer, or any other rights they have under the law.

The Sponsors page shows an anonymous summary of payments from the last 30 days: their total and number, and the day and amount of each payment, with no supporter details. The Sponsors page and the link to it may be unavailable in some countries.

12. Copyright

The Site's content, including text, graphics and the app's code, is protected by copyright. It may be used within the limits of permitted use under copyright law. Other parties' names and trademarks belong to their owners. Licences of the open-source components used are listed on the About page.

By publishing an entry in the “Recently heard” feed, the User agrees that it may be displayed on the Site and made available through the public API free of charge for as long as the entry is kept.

13. Personal data

How personal data is processed is described in the privacy policy.

14. Changes to these terms

The Provider may change these terms for good reason, such as a change in the law, a change to or addition of Site features, or security. A new version applies from the day it is published on this page. Entries published and payments made earlier are governed by the version in force when they were made.

15. Final provisions

These terms are governed by Polish law. A consumer living in another country keeps the protection given by the mandatory laws of that country. Disputes with consumers are settled by the court with jurisdiction under general rules, and disputes with businesses by the court with jurisdiction over the Provider's registered address.

These terms are available in Polish and English. If the versions differ, the Polish version prevails. The terms apply from the date shown at the top of this page.
